Bankruptcy Laws: What are Chapter 7, Chapter 13, and Chapter 11?

Also known as a consumer debt adjustment or wage earner plan, a Chapter 13 bankruptcy provides a way to re-pay all or a portion of your debt over a period of 3 to 5 years.  Typically, you can keep all of your necessary assets in a Chapter 13, although that could affect your monthly payment requirements.  Once filed, a Trustee is assigned to administer your Chapter 13 case and to disperse your monthly plan payments to your creditors pursuant to your Chapter 13 Plan.

Chapter 11
A Chapter 11 bankruptcy allows businesses to restructure debts and reject certain troublesome contracts and leases while continuing to operate under the control of the owners and managers.
